What you need to know about the New Jersey personal injury process

• Filing of the lawsuit — New Jersey personal injury lawsuits must be filed within two years of the accident or discovery of a latent injury. We arrange service of process, alerting the defendant of the pending action.
• Discovery — In this stage of the process, each side can demand answers to questions and the production of documents that might hold evidence relevant to the case. We can also depose parties and witnesses to the injury event.
• Nonbinding arbitration —Every PI case in New Jersey goes to mandatory nonbinding arbitration. This means you must informally try the case before an arbiter, who renders a decision as a judge would, but neither side is obligated to accept the result. Parties who reject the result then file for a trial de novo. If no one files, the case settles for the arbiter’s amount.
• Settlement conference — While awaiting trial de novo in civil court, the parties can meet to negotiate a settlement.
• Trial — If settlement talks stall, the case goes to trial before a judge or jury.
